Kaffee: [ariving in the conference room after the meeting has already started] Excuse me, sorry I'm late. Capt. Whitaker: That's alright, Danny, I know you don't have a good excuse, so I won't force you to come up with a bad one. Kaffee: [gratefully, nods] Thank you, sir. Capt. Whitaker: The first one's for you. Seems you're moving up in the world, you've been requested by Division. Kaffee: Requested to do what? Capt. Whitaker: Guantanamo Bay, Cuba. A Marine corporal named Dawson illegally fires a round of his weapon over the fence line and into Cuban territory. Kaffee: What's a fence line? Capt. Whitaker: Sam. Lt. Weinberg: A big wall separating the good guys from the bad guys. Kaffee: [sarcastically] Teacher's pet. Capt. Whitaker: PFC William Santiago threatens to rat on Dawson to the Naval Investigative Service. Dawson, and another member of his squad PFC Louden Downey, go into Santiago's barracks room, tie him up, stuff a rag down his throat. An hour later Santiago's dead. The attending physician says the rag was treated with some kind of toxin. Kaffee: They poisoned the rag? Capt. Whitaker: Not according to them. Kaffee: What do they say? Capt. Whitaker: Not much. They're being flown up here tomorrow. Then Wednesday at 0600 you're catching a transport down to Cuba for the day to find out what you can. In the meantime, go see Lieutenant Commander Joanne Galloway of internal affairs. Any questions? Kaffee: That flight to Cuba, was that 0600 in the morning? Sir? Capt. Whitaker: It seems important to Division that this one be handled by the book so I'm assigning co-counsel. Any volunteers? Lt. Weinberg: No! Capt. Whitaker: Sam. Lt. Weinberg: Sir, I've got a stack of papers on my desk about a mile high. Capt. Whitaker: Work with Kaffee on this. Lt. Weinberg: Doing what? Kaffee will have this done in about four days. Capt. Whitaker: Doing various administrative things. Backup. Whatever. Lt. Weinberg: In other words I have no responsibilities whatsoever. Capt. Whitaker: Right.

It's all right, Danny. I know you don't have a good excuse...
00:00:05.569 --> 00:00:07.428
so I won't force you to come up with a bad one.
00:00:07.504 --> 00:00:10.439
- Thank you, sir. - This first one's for you.
00:00:11.208 --> 00:00:13.574
Seems you're moving up in the world.
00:00:13.644 --> 00:00:15.578
Been requested by Division.
00:00:16.048 --> 00:00:18.414
Requested to do what?
00:00:18.482 --> 00:00:20.848
Guantanamo Bay, Cuba.
00:00:20.918 --> 00:00:24.979
A Marine corporal named Dawson illegally fires a round from his weapon...
00:00:25.055 --> 00:00:27.922
over the fence line and into Cuban territory.
00:00:27.992 --> 00:00:29.892
- What's a fence line? - Sam.
00:00:29.096 --> 00:00:34.158
A big wall separating the good guys from the bad guys.
00:00:34.231 --> 00:00:37.496
- Teacher's pet. - P.F.C. William Santiago...
00:00:37.568 --> 00:00:40.901
threatens to rat on Dawson to Naval Investigative Service.
00:00:40.971 --> 00:00:42.996
Dawson and another member of his squad...
00:00:43.073 --> 00:00:47.996
P.F.C. Louden Downey, go into Santiago's room...
00:00:47.111 --> 00:00:50.512
tie him up, stuff a rag down his throat...
00:00:50.581 --> 00:00:52.674
and an hour later, Santiago's dead.
00:00:52.075 --> 00:00:56.447
Attending physician says the rag was treated with some kind of toxin.
00:00:56.052 --> 00:00:57.748
They poisoned the rag?
00:00:57.821 --> 00:01:00.756
- Not according to them. - What did they say?
00:01:00.824 --> 00:01:03.452
Not much. They're being flown up here tomorrow...
00:01:03.527 --> 00:01:06.985
and on Wednesday at 0600, you'll catch a transport down to Cuba for the day...
00:01:07.993 --> 00:01:08.998
to find out what you can.
00:01:09.003 --> 00:01:12.001
Meantime, go and see Lieutenant Commander Joanne Galloway...
00:01:14.001 --> 00:01:15.999
with Internal Affairs.
00:01:16.006 --> 00:01:17.999
Any questions?
00:01:17.001 --> 00:01:21.001
Uh, the flight to Cuba... Was that 0600 in the morning, sir?
00:01:22.813 --> 00:01:25.413
Seems important to Division that this one be handled by the book.
00:01:25.482 --> 00:01:29.309
So I'm assigning co-counsel. Any volunteers?
00:01:31.005 --> 00:01:31.081
No!
00:01:31.989 --> 00:01:34.998
I got a stack of papers on my desk about a mile high.
00:01:34.158 --> 00:01:35.992
- Work with Kaffee on this. - Doing what?
00:01:36.002 --> 00:01:38.001
Kaffee will have this done in about four days.
00:01:38.999 --> 00:01:41.627
Doing various administrative things.
00:01:41.699 --> 00:01:43.633
Backup, whatever.
00:01:43.999 --> 00:01:46.261
In other words, I have no responsibilities here whatsoever.
00:01:46.337 --> 00:01:47.827
Right.
00:01:47.905 --> 00:01:49.998
My kind of case.
00:01:51.003 --> 00:01:53.003
Right.
00:01:53.143 --> 00:01:55.634
Okay, but I've got to have that report by Wednesday.
00:02:02.005 --> 00:02:04.749
- Hi. - Hold on. Hi.
00:02:04.822 --> 00:02:07.154
Daniel Kaffee. I was told to me with, uh...
00:02:15.998 --> 00:02:17.999
Lieutenant Commander Galloway.
00:02:19.001 --> 00:02:21.011
About a briefing?
00:02:21.999 --> 00:02:23.987
I'll call you back.
00:02:25.001 --> 00:02:27.001
You're the attorney Division assigned?
00:02:28.999 --> 00:02:30.999
I'm lead counsel. This is Sam Weinberg.
00:02:30.614 --> 00:02:32.001
I have no responsibilities here whatsoever.
00:02:32.999 --> 00:02:35.996
Come in, please. Have a seat.
00:02:45.999 --> 00:02:47.999
Lieutenant, how long have you been in the Navy?
00:02:49.001 --> 00:02:51.233
Going on nine months now.
00:02:51.999 --> 00:02:53.001
And how long have you been out of law school?
00:02:55.999 --> 00:02:56.572
A little over a year.
00:02:56.999 --> 00:02:58.733
I see.
00:02:59.476 --> 00:03:01.012
Have I done something wrong?
00:03:01.001 --> 00:03:04.005
No. It's just that when I petition Division to have counsel assigned...
00:03:04.989 --> 00:03:05.001
I was hoping I'd be taken seriously.
00:03:05.001 --> 00:03:08.001
No offense taken, in case you were wondering.
00:03:08.999 --> 00:03:10.584
Commander, Lieutenant Kaffee is generally...
00:03:10.654 --> 00:03:13.001
considered the best litigator in our office.
00:03:13.003 --> 00:03:16.321
He's successfully plea-bargained 44 cases in nine months.
00:03:16.393 --> 00:03:18.999
One more, I get a set of steak knives.
00:03:18.999 --> 00:03:20.999
Have you ever been in a courtroom?
00:03:20.001 --> 00:03:22.999
I once had my driver's license suspended.
00:03:22.999 --> 00:03:25.501
Commander, from what I understand, if this thing goes to court...
00:03:25.001 --> 00:03:27.001
they won't need a lawyer, they'll need a priest.
00:03:27.999 --> 00:03:29.001
No, they'll need a lawyer.
00:03:30.774 --> 00:03:32.833
Dawson's family's been contacted.
00:03:32.091 --> 00:03:36.001
Downey's closest living relative is Ginny Miller, his aunt.
00:03:36.001 --> 00:03:39.999
She hasn't been contacted yet. Would you like me to take care of that?
00:03:39.483 --> 00:03:40.001
Sure. If you feel like it.
00:03:42.999 --> 00:03:44.001
One of the people you'll be seeing down there...
00:03:44.755 --> 00:03:46.999
is the barracks C.O., Colonel Nathan Jessup.
00:03:46.999 --> 00:03:49.996
I assume you've heard of him.
00:03:49.989 --> 00:03:50.001
Who hasn't?
00:03:51.595 --> 00:03:54.999
He's been in the papers lately. He's expected to be appointed...
00:03:54.001 --> 00:03:57.008
director of operations of National Security Council.
00:03:57.167 --> 00:03:58.999
- Really? - These are the letters...
00:03:58.001 --> 00:04:00.833
that Santiago wrote in his eight months at Gitmo.
00:04:00.904 --> 00:04:03.001
- That's Guantanamo Bay. - I knew that one.
00:04:03.044 --> 00:04:06.001
He wrote to the fleet commander to the commandant of the Marine Corps.
00:04:07.011 --> 00:04:09.001
Even his senator. He wanted to be transferred off the base.
00:04:10.997 --> 00:04:11.999
No one was listening. Are you with me?
00:04:12.007 --> 00:04:13.001
Yeah.
00:04:15.185 --> 00:04:17.998
Finally, he wrote to the Naval Investigative Service...
00:04:17.001 --> 00:04:20.002
where he offered information about Corporal Dawson's fence line shooting...
00:04:20.002 --> 00:04:22.001
in exchange for a transfer.
00:04:23.002 --> 00:04:25.999
Right. Is that all?
00:04:25.998 --> 00:04:27.697
Lieutenant, this letter makes it look like...
00:04:27.999 --> 00:04:30.001
your client had a motive to kill Santiago.
00:04:30.267 --> 00:04:33.998
Got you. And Santiago is who?
